GENERAL TERMS AND CONDITIONS
OF SALE

 

I. Application

These General Terms and Conditions of Sale (hereinafter referred to as the “Terms and Conditions”) apply to all sales transactions concluded between the Hotel (hereinafter referred to as the “Company”) and the Client.

They supersede and replace any previous versions that may have been published online and/or accepted by the Client.

These Terms and Conditions apply to any use of the website, including but not limited to the online or telephone sale of any services offered on the website by HOTEL GRAMONT PARIS.

It is therefore essential that the Client carefully reads these Terms and Conditions, which are accessible through a hyperlink on every page of the website. The Client is strongly advised to download and/or print a copy at the time of booking, as the Terms and Conditions may be subject to modification. However, such modifications will not apply retroactively to bookings made prior to the change.

The Terms and Conditions may be supplemented by specific terms mentioned in the description of a service, as well as by the terms and conditions of third-party providers, which can be accessed either on their websites or on-site.

II. Capacity

The Client confirms that they are legally capable of entering into a contract, meaning that they are of legal age and not under guardianship or curatorship.

The Client also declares that they are using the website in accordance with these Terms and Conditions, on their own behalf and on behalf of all beneficiaries of the services ordered through the website (hereinafter the “Beneficiaries”), for whom the Client acts as an authorized representative. These Terms and Conditions are binding on all such Beneficiaries.

The Client is financially responsible for all use of the website made in their name or on behalf of the Beneficiaries, except in cases of proven fraudulent use not resulting from their fault or negligence.

The Client guarantees the accuracy and truthfulness of all information provided by them on their own behalf and on behalf of all Beneficiaries using their data on the website.

The Company reserves the right to refuse to enter into a contract with any Client who makes fraudulent use of the website or who violates these Terms and Conditions.

III. Right of Withdrawal

In accordance with Article L 221-28 of the French Consumer Code, the services offered on the website by the Company are not subject to the right of withdrawal provided for in Articles L 221-18 et seq. of the French Consumer Code concerning distance selling.

Therefore, services ordered on the website are exclusively subject to the cancellation and modification conditions provided in these Terms and Conditions, and the Client cannot claim any right of withdrawal.

IV. Prices

Prices are indicated in Euros and include VAT. Any change in the applicable tax rate or the introduction of new legal taxes by the competent authorities will automatically affect the prices on the date of billing.

Rates are per room, for the number of persons specified, and for the selected period.

Prices include only the services explicitly mentioned in the booking confirmation. Any additional services provided by the hotel during the stay and, if applicable, the tourist tax will be added to the price stated in the booking confirmation.

The prices listed on the website are subject to change at any time by the Hotel without prior notice. Only the price confirmed by the Company in the booking confirmation is binding.

V. Security Deposit upon Arrival

Upon arrival at the hotel, a security deposit will be requested to cover any potential damage, breakage, or missing items noticed during your stay.

The amount is set at €50 per night, up to a maximum of €150 per stay.

This deposit may be made:

  • by pre-authorization on a credit card (no immediate debit is made — the amount is simply held during the stay and released upon departure), or
  • in cash, refunded at check-out after inspection of the room.

VI. Online Bookings

When placing a booking, the Client must:

  1. Complete the identification form, providing all requested contact details.
  2. Complete the online booking form, indicating all chosen products or services.
  3. Verify and confirm their booking.
  4. Make payment under the conditions specified, and confirm the booking and payment in the case of a Non-Refundable rate, or provide banking details in the case of a Flexible rate.

Any booking of more than five (5) rooms may be subject to special conditions and additional charges.

Confirmation of the booking implies acceptance of these Terms and Conditions, acknowledgment of having full knowledge thereof, and waiver of any conflicting purchasing terms or conditions.

All data provided and the recorded confirmation shall constitute proof of the transaction. The confirmation shall serve as a signature and express acceptance of the operations carried out.

The Company will send the Client a booking confirmation by any means (email, postal mail, fax, etc.).

A booking becomes firm and final only upon receipt of the confirmation sent to the Client by the Company.

Rates, terms, and booking conditions are intended solely for hotel room reservations for accommodation purposes.

The Hotel reserves the right to modify or cancel any reservation, rate, or condition if rooms are used for purposes other than accommodation — such as parties, dinners, meetings, photo or video shoots, film or interview recordings, social media shoots, showrooms, etc. (non-exhaustive list) — without prior written authorization from management.

The number of guests in each room must not exceed the number specified in the reservation and must comply with the maximum occupancy approved by the Paris Police Prefecture (available upon request from hotel management).

VII. Online Payment Terms

Depending on the type of booking, payment may be required either at the time of booking (Advance Purchase plan) or at the end of the stay (Flexible plan).

In all cases, to guarantee the reservation, the Client must provide a valid credit card number via a secure system.

For prepaid bookings, the Client’s credit card information is transmitted securely to the Company, which debits the total amount of the stay at the time of booking. The Client’s account is charged on the booking date, and the invoice is provided upon departure from the Hotel.

Please note that the credit card used for the reservation must be presented upon arrival by its holder. If not, a new credit card will be required for payment at check-in.

In cases where the stay is paid by a third party, the Hotel may request supporting documents to ensure the security of the transaction.

Please also note that the Hotel reserves the right to pre-authorize your credit card at any time prior to arrival.

VIII. Modification and/or Cancellation of a Booking

Cancellations and/or modifications of bookings are permitted according to the rate plan selected by the Client.

For a “Flexible Rate”:
Any modification or cancellation request must be made as soon as possible and no later than 48 hours prior to arrival.
A modification or cancellation is only confirmed once the Client has received an email confirmation from the Company.
The date of receipt of the modification or cancellation request (by email, mail, or phone) shall be the date considered for the request.

For a “Non-Refundable Rate (NR)”:
No modification or cancellation will be accepted, and the full amount of the stay will remain due to the Hotel.

In the event of a no-show:

  1. For a “Non-Refundable Rate,” the full amount of the reservation will be retained by the Hotel.
  2. For a “Flexible Rate,” the first night will be charged.

For stays of two nights or more, if the Client fails to arrive on the first day, the Hotel is not obligated to hold the room for the remaining nights.

Clients are requested to check in before 6:00 p.m. and to inform the Hotel of late arrivals, failing which they may be considered as no-shows.

IX. Relocation

If the Hotel is unavailable or in case of force majeure, it reserves the right to relocate the Client to a hotel of equivalent or higher category offering similar services. Transfer costs will be covered by the original Hotel, and no further compensation may be claimed.

X. Additional Services – Packages

Orders for additional services or packages may only be placed simultaneously with a room reservation for specific, predetermined dates.

They may only be used during the Client’s stay at the Hotel and may be modified or canceled only under the conditions set out in Article VII above.

Within 48 hours of arrival, any order for additional services will be confirmed only upon receipt of written confirmation from the Hotel.

XI. Force Majeure

Force majeure refers to any unforeseeable, irresistible external event that prevents either party from fulfilling all or part of their contractual obligations.

This includes, but is not limited to, strikes, uprisings, riots, and government-imposed restrictions or prohibitions.

It is expressly agreed that force majeure suspends the parties’ obligations, and each party shall bear the costs resulting therefrom.

Clients shall bear any additional expenses incurred to continue their travel following a case of force majeure.

XII. Complaints

Any complaint must be addressed to:

within 15 days after the end of the stay in question. After this period, no complaint will be considered.

XIII. Consumer Mediation

In the event of a dispute between the professional and the consumer, both parties shall endeavor to reach an amicable solution.

If no agreement is reached, the consumer may contact the consumer mediator to whom the professional belongs — Association des Médiateurs Européens (AME CONSO) — free of charge, within one year of submitting a written complaint to the professional.

The consumer may contact the mediator:

XIV. Data Protection

In accordance with French Law No. 78-17 (“Informatique et Libertés”), Clients are informed that their reservation is subject to computerized personal data processing. Clients have the right to access and correct their data by contacting:

This information will not be shared with third parties.

The Hotel provides Wi-Fi internet access. The Client agrees not to use this access to reproduce, distribute, or make available copyrighted or protected works (texts, images, photographs, audiovisual works, software, video games, etc.) without the authorization of the rights holders as provided by the French Intellectual Property Code.

The Hotel is equipped with a video surveillance system in the common areas.

XIV. Liability

The Company declines all responsibility in the event of theft, loss, or damage to Clients’ belongings during their stay.

The Client shall be held responsible for any damage, deterioration, or act of vandalism caused by themselves, their guests, or their staff to movable property, decor, or the building, whether belonging to the Hotel or not. Consequently, the Company reserves the right to require the Client to leave the premises without compensation or refund and to reimburse all damages caused.

As a security measure, the Hotel will request a deposit at check-in ranging from €50 to €150, which may be taken as a pre-authorization on a credit card or in cash.

The Company, in conducting online sales, is bound only by an obligation of means. It shall not be held liable for damages resulting from use of the Internet, such as data loss, intrusion, viruses, service interruption, or other unintentional issues.

XV. Governing Law

These General Terms and Conditions of Sale are governed by French law, both in substance and form. Any disputes shall fall under the exclusive jurisdiction of French courts.
